Agreement
By registering to become an Affiliate in the JB English Affiliate Program (“Program”), you agree to be bound by the following terms and conditions (“Terms of Service”).
JB English reserves the right to update and change the Terms of Service from time to time without notice. Any new features that add to or enhance the current Program, including the release of new tools and resources, are subject to the Terms of Service. Your continued use of the Program after such changes constitutes your agreement to those changes.
Violation of any of the terms below will result in termination of your Account and loss of any outstanding affiliate commission payments earned during the breach.
Account Terms
- You must be 18 years of age or older to be part of this Program.
- Accounts registered by “bots” or other automated methods are not allowed.
- You must provide your full legal name, valid email address and other requested information to complete the registration process.
- Your login can only be used by one person – a single login shared by multiple people is not allowed.
- You are responsible for maintaining the security of your account and password. JB English cannot and will not be liable for any loss or damage resulting from your failure to comply with these security obligations.
- You are responsible for all Content posted and activities that occur under your account.
- One person or legal entity may not have more than one account.
- You may not use the Affiliate Program for any illegal or unauthorized purpose. You may not, in your use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
Links/graphics on your site, in your email, or other communications
Once you register for the Affiliate Program, you will be provided with a unique Affiliate Code. You can use this link on your website or email.
You will earn referral fees only in connection with sales on JB English services that occur directly through your Custom Link; we will not be liable to you in respect of any failure by you or any person you referred to use a Custom Link or mistype your Affiliate Code, including to the extent that such failure may result in a reduction in amounts due to you under this Agreement.
Referral fees/commissions and payments
We value our affiliates and want to make sure that you will get the commissions you deserve. You will get referral fees in connection with sales on JB English services that occur directly through your Special Link. In addition, we always ask our students where they heard about JB English. We ask this question on our registration form and directly before students start their lessons. If students mention your website or email, you will still earn a commission.
We reserve the right to disqualify commissions earned through fraudulent, illegal or overly aggressive, questionable sales or marketing methods.
Payouts only start once you earn more than IDR 500,000 or $50 in affiliate earnings. If your affiliate account never crosses the $50 threshold, your commission will not be realized or paid. We are only responsible for paying for accounts that have crossed the $50 threshold.
payment schedule
As long as your current affiliate income is more than $50 , you will be paid every month. If you haven’t earned $50 since your last payment, we’ll pay you the following month after you cross the threshold.
Responsibility
You will be solely responsible for the development, operation and maintenance of your site and for all material appearing on your site. For example, you will be fully responsible for:
– Technical operation of your site and all related equipment
– Ensure the display of Custom Links on your site does not violate any agreement between you and any third party (including but not limited to any restrictions or requirements placed on you by the third party hosting your site)
– The accuracy, correctness and suitability of the materials posted on your site (including, inter alia, all service-related materials and any information that you include in or are associated with any Custom Links)
– Ensure that material posted on your site does not infringe or violate any third party rights (including, for example, copyright, trademark, privacy, or other personal or proprietary rights)
– Ensure that material posted on your site is not defamatory or illegal
– Ensure that your site accurately and adequately discloses, whether through a privacy policy or otherwise, how you collect, use, store and disclose data ta collected from visitors, including, where applicable, that third parties (including advertisers) may serve content and /or advertisements and collects information directly from visitors and may place or recognize cookies on visitors’ browsers.
Compliance with Law
As a condition of your participation in the Program, you agree that as long as you are a participant in the Program, you will comply with all laws, ordinances, rules, regulations, orders, licenses, permits, judgments, decisions, or other requirements of any governmental authority having jurisdiction over you, what is the law, etc. which is now in effect or will come into effect as long as you are a Program participant. Without limiting the obligations above, you agree that as a condition of your participation in the Program, you will comply with all applicable laws governing email marketing, including but not limited to, the CAN-SPAM Act of 2003 and all anti-spam laws. -other spam.
Term of Agreement and Program
The term of this Agreement will begin after we receive your Program application and will end when terminated by either party. You or we may terminate this Agreement at any time, with or without cause, by giving written notice to the other party of termination. JB English reserves the right to terminate the Program at any time. Upon termination of the program, JB English will pay all accrued earnings above $50 .
Ending
JB English , in its sole discretion, reserves the right to suspend or terminate your account and refuse any and all current or future use of the Program, or any other JB English service, for any reason at any time. Termination of the Service will result in the deactivation or deletion of your Account or your access to your Account, and the confiscation and forfeiture of all potential commissions or that would be paid on your Account if earned through fraudulent, illegal, or overly aggressive and questionable sales or marketing methods. JB English reserves the right to refuse service to anyone for any reason at any time.
Disclaimer
We make no express or implied warranties or representations with respect to the Program or any products sold through the Program (including, without limitation, warranties of merchantability, merchantability, non-infringement, or any implied warranties arising from the course of performance, dealing or use of trading). In addition, we make no representations that the operation of JB English will be uninterrupted or error-free, and we will not be liable for the consequences of any interruptions or errors.
Independent Investigation
YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT AND AGREE TO ALL OF THESE TERMS AND CONDITIONS. YOU ACKNOWLEDGE THAT WE ARE AT ANY TIME (DIRECTLY OR INDIRECTLY) GETTING CUSTOMER REFERENCES WITH TERMS WHICH MAY DIFFER TO THOSE STATED IN THIS AGREEMENT OR OPERATE A WEBSITE SAME OR COMPETITION TO YOUR WEBSITE. YOU HAVE SELF EVALUATED YOUR WITNESS TO PARTICIPATE IN THE PROGRAM AND DO NOT RELY ON ANY REPRESENTATIONS, WARRANTIES OR REPRESENTATIONS OTHER THAN SET FORTH IN THIS AGREEMENT.
Arbitration
Any dispute relating to this Agreement in any way (including any actual or suspected breach of this Agreement), any transaction or activity under this Agreement or your relationship with us or any of our affiliates shall be submitted to confidential arbitration, unless, to the extent that you in any way violate or threaten to infringe our intellectual property rights, we may seek damages or other appropriate remedies in any state or federal court (and you consent to the jurisdiction and non-exclusive place in such courts) or other court of competent jurisdiction. Arbitration based on this agreement will be conducted based on the applicable regulations of the Indonesian National Arbitration Board (BANI Arbitration ).Center). The arbitrator’s award is binding and may be entered as an award in any court of competent jurisdiction. To the maximum extent permitted by applicable law, no arbitration under this Agreement will be combined with an arbitration involving any other party subject to this Agreement, whether by class arbitration proceedings or otherwise.
Others
This Agreement will be governed by the laws of the Government of Indonesia, without reference to the rules governing choice of law. You may not assign this Agreement, by law or otherwise, without our prior written consent. Subject to such limitations, this Agreement will be binding, in the interests of, and enforceable against the parties and their respective successors and assigns. Our failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of our right to further enforce such provision or any other provision of this Agreement.
JB English ‘s failure to exercise or enforce any right or provision of the Terms of Service shall not be construed as a waiver of such right or provision. The Terms of Service constitute the entire agreement between you and JB English and govern your use of the Service, superseding any prior agreement between you and JB English (including, but not limited to, previous versions of the Terms of Service).
